We do not work for trade. We understand that budgets are tight but we offer quality professional services and believe that payment vs. trade of services sets the foundation for a strong, meaningful and deeply respectful relationship.
Our relationships are built on trust; therefore we do not require any of our clients to sign a contract but we do ask that each client carefully read our policies, procedures, terms and copyright and adhere to an understanding of such.
Shivaya Group and our clients agree to act in good faith, and will continue to do so in the negotiation, execution, delivery, performance, and upon any termination of services.
Clients may terminate our business relationship or cancel services at anytime without explanation or reason.
Shivaya Group also reserves the right to terminate a business relationship or cancel services at anytime without explanation or reason.
ALL sales are FINAL. There are NO refunds for deposits and or payments made. If services are cancelled we will release any files or materials that have been paid for.
If you are on a scheduled payment plan, please note that we will not release any native art files until all payments have been received in full.
If payment for services rendered are not paid in full upon termination of services or a payment arrangement cannot be negotiated, Shivaya Group reserves the right to immediately cease all work, shut down services such as website and email hosting and or take the appropriate legal actions.
Shivaya Group retains exclusive rights to approve any changes or reproductions of projects used for anything other than designated in the initial agreement at the start of the project.
No one, whether a client or otherwise has the right to assign, sell, modify or alter projects or designs except upon the express written advance approval of Shayla McCallum, Founder & Creative Director of Shivaya Group. Consent can be withheld for any reason.
Shivaya Group has exclusive rights in producing similar work, any similarities between client's projects constitutes Shivaya Group's methods and style.
Shivaya Group has the right to use all designs and projects for our own promotional purposes and/or to cross-link it with other marketing venues developed by Shivaya Group.
Client warrants that they either legally own or have permission to use everything provided to Shivaya Group for use in projects; ie. pictures, content copy and the like.
Client is responsible for any Copyright or Trademark violations pertaining to their final project files.
All approval mentioned above must come from Shayla McCallum,Founder & Creative Director of Shivaya Group. No other member of Shivaya Group has the authority to make such approvals.
No one may download, copy or use any logo, graphic, image, written copy, or document from this site without the written permission of Shayla McCallum, Shivaya Group's Creator & Director. Clients and staff members whether they work for Shivaya Group or are employed by a client do not have the right to authorize the download, copy or usage of any content on this website.
If you are working with us or one of our clients and need a logo or image please contact us and we will be happy to provide you with the correct files.
